Is there away to have “Select shapes smaller than selected” only apply to visible/shown layers? As it stands now when I use this feature it even if I have the shapes I don’t want selected hidden, grouped with other shapes and locked, they still get selected. Moreover the items that are selected using this feature are automatically ungrouped from whatever group they were in and unlocked (but not un-hidden). I’m guessing this is a bug but if I’m missing something let me know.

I can recreate your scenario, also in RC-3,
The selection should only contain shapes from the active layers and not from hidden layers,

Selection in groups was intended, as users often don’t realize they have to ungroup to edit things, and we have a couple other features that work this way as well (like Select all Layer Shapes).
Selection of hidden or locked shapes is a bug, and I’ll look into that now.
@kylebunker, Oz passed me a note identifying the selection of hidden or locked shapes has been found, fixed and is set for the next update.
